HOLY SHIT. Working night court tonight and I just watched Judge Melissa Lewis set bail on an HIV+ trans woman whose life is now in danger at Rikers, even over the Manhattan DA’s recommendation for supervised release. Absolutely abhorrent.

Ms. Orlins left out the crime this individual was charged with, her past criminal convictions, past failures to appear in court. All these are relevant as why the Judge set bail on this defendant.I am not holding my breath waiting for her to answer any questions as to these facts

More criticism like this, please. There are too many bad judges out there doing too many bad things that devastate too many people. 99% of lawyers are afraid to name them, in no small part because bad judges also don’t hesitate to punish their critics. But it’s important.

Yeah, we can trust the DAs, who believe nothing requires bail, these days. This judge was a DeBlasio appointee. I highly doubt she is tough on crime. I’d need more information, which curiously you seem reluctant to give, before having an opinion on whether bail was justified.
 
I'm a huge proponent of prison reform. People sitting in prison that don't need to be but no one is mentioning the alleged crime. DA, recommending PR with no bail, could be playing politics just as easily as the judge. But "Literally shaking" Eliza isn't telling the whole story.

What is the alleged crime and does the defendant have a criminal history? Contrary to what people say, this DOES matter especially when you have a DA who openly boasts of being lenient on criminals.

Thankful there are still some judges in NY who believe in not letting everyone free. Orlins give no context of the crime, the history of the person etc. just puts a judge in blast- THAT is Abhorrent.

Reminder that it isn’t just cops and DAs who use their positions of power to purposefully inflict harm on the most vulnerable in society. Cruel judges like Melissa Lewis will send people to be tormented in prison even against the advisement of the DAs office.

Option 1) the judge made a bad decision. Option 2) the DA made a bad recommendation. More data is needed to understand which it is. This is aside from the insanity of being able to buy your way out of jail if you’re wealthy enough.

The DA knows what the charge was. STILL recommended supervised release. WE don’t need to know any more than that. DA knows her threat to society.

DAs are not necessarily doing their job these days, but many are promoting their political beliefs. Judges have the authority to override them.

Immediately file a motion to amend bail. Another judge will likely grant the motion if the State and defense don’t object to a supervised release condition.

No one wants anyone’s safety to be at risk but is she herself considered a possible danger to the community/ safety risk to others? If so this decision makes sense. Crime is up in NYC and there’s been an understandable backlash to releasing violent people out on to the streets.
