A spike in violent threats has FBI/DHS issuing an unusual warning following the Mar-a-Lago search, as DOJ argues against revealing the search warrant affidavit.

My 89 year old grandpa is WORKING at that concert right now!! He became a Cubs Ambassador at age 88 to have something to do after my grandma passed away, and specifically requested to work at the Lady Gaga concert 🤣🥰

omg, I love everything about that. Wish they could meet!

I have the best mom in the world. She is about 87 (we don’t know exactly), she works full time, and right now she is at the @ladygaga show at Wrigley Field. That has been her dream! Thank you @tystiklorius and @bobby_campbell.

TW: Cancer

Over the summer we got some truly unthinkable news: My brother’s wife, Alyson—an otherwise healthy, thriving mom to our nephew (7) and niece (5)—was diagnosed with stage 4 pancreatic cancer (1/3)
I am so terribly sorry to hear this. Heartbreaking. We will support this research. You and your family are in my thoughts and prayers.

Kash Patel has to be put in the GJ on this -- Not only was his and Trump's declassification "defense" factually absurd (and not a legal defense to all the possible criminal violations), but now it is refuted by his own taped words, as Ryan aptly notes.

DOJ is appropriately resisting disclosure of the Mar A Lago search affidavit because it will compromise their ongoing investigation. This is very standard and right. That said, what they said -- especially about witnesses -- will invariably drive Trump to be even more worried

New: Forensic experts directed by Trump-allied lawyers copied sensitive data from election systems in Ga. as part of a multistate effort to access voting equipment that was broader and more organized than was previously known washingtonpost.com/investigations…

No question now that Trump is the target of the federal 1/6 probe. And correct move here: Lock people into the GJ.

1. I want to share with you a project that some friends and I have been working on for the better part of a decade. It’s called the Visiting Room. It’s a video archive of 100+ interviews of people serving LWOP sentences at Louisiana’s Angola prison.

Apparently at Mar-a-Lago the FBI has now planted documents that are ALSO protected by the attorney client and executive privileges and that were top secret classified BUT blanket declassified by a Trump order no one had even heard of before now.

Man, these agents are good!

Having your home searched by the FBI based on probable cause concerning national security and obstruction crimes is not a “win” for a former president under any definition of that word.

This just arrived in the mail. Have been wanting to hear it for most of the last two decades! So glad the brilliant ⁦@respektor⁩ has decided to release it along with “Papa’s Bootlegs.” She graces our lives with her every song.

Very legal. Very cool.

Neal you know the law better than most…are you allowed to bring Top secret classified security docs home? Or flush them down the toilet? And if so can you get in trouble for that? Asking for no one in particular, just wondering.

Neal Katyal Retweeted ·
Let’s stop falling for Trump’s diversionary tactic of focusing on his latest absurd “defense” du jour —and instead keep asking why he still has not said why he took the documents, why he did not return them, and what he did with them and/or or was planning to do with them?

As a Senator, when I need to look at classified documents I have to go into a secure room in the Senate. No staff. No phones. I can’t even wear my Fitbit.

Mar-a-lago, where you can rent tennis racquets and golf clubs…and croquet sets. No, that’s not a secure location.

Neal Katyal Retweeted ·
Some are arguing, as does @AndrewCMcCarthy below, that the warrant used to search Mar-A-Lago was a general warrant that violates the 4th Amendment.

I think this is incorrect. Here's a thread that explains my view, looking at the relevant caselaw.

The top lawyer at the National Security Agency during Trump's presidency says Trump's latest defense - claiming he had a standing order declassifying the info in whatever docs he happened to take from the Oval Office to the residence - is "preposterous." nytimes.com/2022/08/14/us/…

Okay, everyone’s discussing the TS-SCI docs…fewer focused on the “French President info.”

Before visits, leaders get in-depth/confidential assessments on foreign leaders from the intel community.

Those reports can be “juicy” & need to be kept very “close hold.”

Prosecutors could indict Trump — under 18 USC 1001/1519 — if he intentionally gave his lawyer false info to pass to DOJ.

Smart prosecutors can put lawyer on stand and ask narrow questions.

Don’t take my word for it. Just ask Paul Manafort’s chief prosecutor @AWeissmann_.

NEW: At least one lawyer for Trump signed a written statement for the Justice Department asserting all docs with classified markings in the boxes had been returned after a June 3 meeting, which could explain why "obstruction" statute was listed on warrant nytimes.com/2022/08/13/us/…

One thing getting elided at the moment is that apart from the niceties of classification - which aren't on Trump's side - this is quickly coming down to: why'd you have that stuff? Why wouldn't you give it back? And what were you doing with it?

I spent two decades in the military with a TS/SCI clearance…. I never - NEVER - brought “home my work from time to time.”

It’s illegal. And it’s a violation of the lifelong contract one signs prior to accessing classified material.

No former president in our nation’s history has invoked the Fifth Amendment 440 times in a state AG civil financial fraud case, and had his house searched by the FBI pursuant to a warrant in a separate federal national security case, let alone in the same week.

Neal Katyal Retweeted ·
Brilliant tactical move by DOJ on selecting statutes for the search. None of the crimes cited require the documents to be classified. Any claim by Trump that he declassified the documents is irrelevant. I’ll discuss at 7 am ET on @MSNBC.

Pulling a bunch of threads together, the fact that the search warrant was based on §§ 793, 1519, and 2071, but *not* 1924, suggests that DOJ was worried about affirmative *misuse* of materials in President Trump’s possession — and not just that he was wrongfully *retaining* them.
